1. Nature of Services
Heavy Shipping LLC functions as a logistics coordinator and freight broker. We arrange for the transportation of heavy machinery, automotive infrastructure, and industrial equipment by connecting shippers with licensed motor carriers. We are not a motor carrier ourselves. The actual transportation of your freight is performed by independent third-party carriers.
2. Accuracy of Quote Information
When requesting a freight quote for equipment (such as car lifts, mowers, or excavators), you agree to provide complete and strictly accurate information. This includes:
- Exact weight and dimensions (including pallets, crating, or packaging).
- Accurate origin and destination addresses.
- Accurate site conditions (e.g., residential vs. commercial, liftgate requirements, limited access).
Liability for Discrepancies: Motor carriers utilize certified scales and lasers to audit shipments. If the actual dimensions, weight, or delivery conditions differ from the information you provided at quoting, you are legally responsible for all resulting accessorial fees, reweigh charges, or reclassification fees billed by the carrier.
3. Payment Terms
All freight charges must be paid in full prior to the dispatch of a truck unless you have an established net-terms credit account with Heavy Shipping LLC. If a carrier applies post-delivery accessorial charges due to inaccurate quoting information or extended unloading times (detention), you authorize Heavy Shipping LLC to invoice you or charge your payment method on file for these exact overages.
4. Transit Times and Delays
All transit times and delivery dates provided by Heavy Shipping LLC are estimates only. We do not guarantee delivery dates. Transit times exclude weekends and holidays. Heavy Shipping LLC is not liable for delays caused by weather, road conditions, weigh station inspections, carrier equipment failure, or Acts of God.
5. Freight Damage and Claims
Because Heavy Shipping LLC is not the motor carrier, we are not directly liable for loss or damage to freight in transit. Liability for transit damage rests with the motor carrier handling the load. Your responsibilities regarding inspection, refusing freight, and reporting concealed damage are governed exclusively by our Damage & Freight Claims Policy.
6. Limitation of Liability
To the maximum extent permitted by law, Heavy Shipping LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our logistics services or any delay in freight delivery.
7. Intellectual Property
The Site and its original content, features, and functionality are owned by Heavy Shipping LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not reproduce or distribute our content without written permission.
8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or our services shall be brought exclusively in the state or federal courts located in Hillsborough County, Tampa, Florida.
